Terms and Conditions

PLEASE READ THIS AGREEMENT CAREFULLY. IT SETS FORTH THE LEGALLY BINDING TERMS AND CONDITIONS FOR YOUR USE OF THE SERVICES.

In consideration of Your use of any of the MyBicycles Services (defined below) provided by Biswaas Enterprises, operator of MyBicycles Public Bicycles Sharing Services, requires that You (“Rider”, “You”, or “Your”) agree to all terms and conditions in this Agreement, Waiver of Liability, and Release (“Agreement”), as applicable.

The “Services” provided by MyBicycles are composed of the following including

1. Our service share smart bicycles (“MyBicycles"), Light weight smart pedal bicycles.
2. All other related equipment, personnel, charging stations for bicycles, mobile applications, websites and information provided or made available by MyBicycles. (collectively, the "MyBicycles")

Please CAREFULLY READ all terms and conditions before entering into this Agreement. Here is a list of some of the terms that MyBicycles wants to bring to your notice in the event you are on a smartphone or other device with a small screen. Capitalized terms have the meanings given to them where defined in this Agreement.

On completion of your ride, the Bicycle must be locked and parked at respective designated MyBicycle Stands. If the Bicycle is not locked and parked at MyBicycle Stands, the trip will continue and you will continue to be charged. MyBicycle holds the rights to end your ride and charge a non-compliance fee of up to INR 5000.

1. Standard Rent of bicycle hire is Rs. 10/- per hour, but it may be less or more from the standard rent due to operating policies in various cities of operations.
2. The maximum charge for a single bicycle ("MyBicycles") trip is INR 240 for 24 hours excluding any non-compliance charges.
3. On completion of your ride, park the Bicycle at a MyBicycle designated Stands following all the laws. The Bicycle cannot be parked in non-public spot, private property or in an area that is locked.
4. You must follow all traffic laws, e.g. any cycling lane laws in your area.
5. If there is a damage or malfunction in the Bicycle, you must immediately report it to MyBicycles via the App Support feature or e-mail - info@mybicycles.in
6. MyBicycles clearly agrees to let, and the Rider clearly agrees to take on, rental of the Bicycle subject to the terms and conditions set out herein. Unless otherwise indicated, all monetary values set forth in this Agreement shall be deemed to be denominated in Indian Rupees.
7. Rider certifies that he/she is at least 14 years old. Minors who are at least 12 years of age may use MyBicycle, but only if the Service is subscribed for by and under the responsibility of the minor’s parent or legal guardian. By consenting use of the Service by a minor, the parent or legal guardian agrees he/she is fully responsible and liable for all injuries, damages, and costs and expenses arising from or related to the minor’s use of the Service and guarantees, represents, and warrants: (i) the parent’s or legal guardian’s; and (ii) the minor’s acceptance of and agreement and compliance with all terms and conditions of this Agreement as a Rider.
8. Only registered mobile is valid to use services.
9. Bicycle will be issued on first come first serve basis.
10. Minimum Recharge amount is Rs. 50/-.
11. Refunds/Cancellations: Recharge amount will not be refunded in any case. 
12. Validity will be one year from the date of last recharge.
13. Fare/charges are payable as applicable at the time of transaction and can be changed without any prior intimation.
14. If cycle is not returned within 12 Hrs., legal action will be initiated.
15. Any change in credentials must be updated Mobile number can’t be changed, and MyBicycle Mobile App can’t be installed on multiple devices.
16. No cycle will be issued before 30 Minutes of closure time.
17. Biswaas Enterprises reserves the right to change terms and conditions from time to time without prior intimation.
18. Any damages/loss to the cycle will be borne by the commuter.
19. All disputes are subject to Delhi Jurisdiction.
20. Important: Cycle issue and Deposit should be done thru QR Code on user’s Mobile Handset and Handheld device with Attendant at MyBicycles stands only. Depositing cycle elsewhere will be responsibility of Commuter. Any upgrade to cycle issue/ deposit system should be followed as and when done.
21. Only one cycle will be issued to a registered user at a time.
22. The Biswaas Enterprises operator of "MyBicycles" is neither responsible nor liable to pay any compensation is case of any accident/untoward incident.
23. Biswaas Enterprises has right to reject any application/cancel the registration without assigning any reason.
24. App account balance neither transferable nor refundable.
25. Taxes extra on all charges wherever applicable.
26. If you find any terms not suitable, you should stop using this app and must uninstall.
